Terms of Service

Effective Date: September 17, 2025

These Terms govern your use of the Fetch communications platform and related services provided by VetAILs, Inc. ("VetAILs," "we," "us"). If you are an End User receiving messages from a Clinic via Fetch, additional details may appear in the Clinic's own communications.

1) The Services

Fetch enables Clinics to send appointment reminders, visit follow-ups, feedback requests, and clinic updates to End Users via SMS/email and to collect responses/feedback.

2) Accounts & Eligibility

If you create a platform account (e.g., Clinic staff), you must provide accurate information, keep credentials secure, and be authorized by your organization. The Services are not for children under 13.

3) Roles & Responsibility

  • Clinics control message content, recipients, timing, and legal basis for Clinic communications.
  • VetAILs provides the platform, routing, logging, analytics, and related features.
  • Clinics are responsible for complying with laws (e.g., consent/TCPA/CTIA, email rules, privacy) when using the Services.

4) Acceptable Use

Do not misuse the Services (e.g., unauthorized access, disruption, automated abuse, unlawful/deceptive/harassing content, IP violations, or any illegal activity).

5) SMS/Text & Email Program Terms (End Users)

Opt-in required. Unless otherwise stated by the Clinic, SMS frequency is up to 4 messages per month; message & data rates may apply; reply STOP to unsubscribe, HELP for help; carriers are not liable for delayed/undelivered messages. Consent is not a condition of purchase or service. Messages are informational and not medical advice; for emergencies, contact the Clinic by phone or seek urgent care.

6) Privacy

Use of the Services is subject to the Platform Privacy Policy (https://vetails.com/privacy). When VetAILs processes data on a Clinic's behalf, the Clinic's privacy practices apply to that processing; contact the Clinic for Clinic-specific requests.

7) Third-Party Services

Delivery relies on carriers, email providers, cloud hosting, analytics, payments, and other vendors. We are not responsible for third-party outages or changes beyond our reasonable control.

8) Intellectual Property

The Services, software, and content are owned by VetAILs or licensors. You receive a limited, non-exclusive, non-transferable right to use the Services as intended and in compliance with these Terms.

9) Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

10) Limitation of Liability

To the fullest extent permitted by law, VetAILs and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability for any claim related to the Services will not exceed $100.

11) Indemnification

You (and your organization, if applicable) agree to defend, indemnify, and hold harmless VetAILs from claims arising from your misuse of the Services or violation of these Terms or law.

12) Suspension & Termination

We may suspend or terminate access for any reason, including security risks, suspected misuse, legal requirements, or non-payment (for Clinic accounts). You may stop using the Services at any time; End Users can unsubscribe per Section 5.

13) Modifications

We may update the Services or these Terms. If changes are material, we will provide reasonable notice and update the Effective Date. Continued use after the effective date constitutes acceptance.

14) Governing Law & Disputes

These Terms are governed by New York, USA. Exclusive venue is New York County, New York for disputes not eligible for small-claims court. Class actions are waived to the maximum extent permitted by law.
